						 <p>Arizona's modest enforcement measures are under attack by the very federal government whose failure to secure the border precipitated their adoption. Is Arizona at the mercy of the Obama administration, or does it have some options here?</p> <p>Many people are asking, &quot;What can Arizona do?&quot; Ray Hartwell gives one possible answer in his recent commentary <a href="http://www.washingtontimes.com/news/2010/jul/16/obama-lawsuit-invites-fortified-state-militia/print/" target="_blank">Obama lawsuit invites fortified state militia</a> (published by the Washington Times).</p> <p><object width="480" height="385"><param name="movie" value="http://www.youtube.com/v/1q1LYkv_-h8&amp;hl=en_US&amp;fs=1" /> <param name="allowFullScreen" value="true" /> <param name="allowscriptaccess" value="always" /> <embed src="http://www.youtube.com/v/1q1LYkv_-h8&amp;hl=en_US&amp;fs=1" type="application/x-shockwave-flash" allowscriptaccess="always" allowfullscreen="true" width="480" height="385" /></object></p> <p>Hartwell writes, &quot;Arizona and her sister states in the Southwest could take dramatically stronger actions to bring order to the border. And they would have both history and the Constitution on their side.&quot; Then Hartwell goes on to give the history of the Pancho Villa, and points out that Arizona can form and expand its own state militia. Such forces were common when our nation was founded, and the Second Amendment recognizes that a &quot;well-regulated Militia&quot; is &quot;necessary to the security of a free State.&quot; In short, Arizona and other states can raise and arm their own military forces.</p> <blockquote> <p>The Constitution is informative here. In Article IV, Section 4, the federal government is required to &quot;protect each [state] against Invasion; and [on request of the state government] against domestic Violence.&quot; As St. George Tucker noted, this provision guards against &quot;the possibility of an undue partiality in the federal government,&quot; for example a &quot;sectional&quot; president who might, for political reasons, decline to protect states in a certain region. Today the federal government, at the direction of the president, has declined to carry out its duty under Article IV. Leaving aside its other possible consequences, this intentional failure to protect Arizona raises the question of what action the state is now entitled to take under the Constitution.</p> <p>This brings us to Article I, Section 10, Clause 3, which provides that &quot;No State shall, without the Consent of Congress &#8230; engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay.&quot;</p> <p>So, the militias organized and armed by a state may go to war when the state has been invaded or is in imminent danger. This is clear under Article I, and plainly justified when the federal government has deliberately failed to protect against invasion as required by Article IV. As Joseph Story explains in his treatise on the Constitution, the prohibition against states engaging in war is &quot;wisely&quot; limited by &quot;exceptions sufficient for the safety of the states, and not justly open to the objection of being dangerous to the Union.&quot;</p> <p>At the time of our nation's founding, the states surrendered certain limited powers to the federal government. Logically, foremost among the enumerated powers delegated to the new central authority were those relating to foreign affairs, including the war powers. But the states were prudent; they had a logical concern that if the federal government should fail in its duty to protect them from &quot;invasion&quot; or &quot;imminent danger,&quot; perhaps for reasons of political &quot;partiality,&quot; then the states should have a robust right to defend themselves, including by armed force. After all, we seem more than happy to help other nations secure their borders. In fact, U.S. Homeland Security Secretary Janet Napolitano has just agreed to help <a href="http://www.worldtribune.com/worldtribune/WTARC/2010/me_gulf0487_06_03.asp" target="_blank">Saudi Arabia secure its dangerous border</a> areas near Yemen. Not only that, we have secured the border between South Korea and North Korea so well that not a single North Korean has crossed over the border illegally in over 50 years. And yet we continue to leave our border with Mexico completely wide open.</p> <p>What in the world is going on?</p> <p>This is a national nightmare and it is getting worse by the day.</p> <p>If we do not do anything, crime will continue to get worse, gang violence will continue to get worse, drug dealing with continue to get worse and more law enforcement authorities will continue to be killed.</p> <p>This is a desperate national security problem that needs an urgent solution.<br /> But it seem clear, as long as Barack Obama is in the White House, nothing is going to be done about illegal immigration. So if you live in an area that is crawling with Mexican drug smugglers, the truth is that you only have two options, either get used to it or move somewhere else.</p> <p>In order to get to the root of the matter one must asked, “who is driving the agenda to destroy America?” and “why do they want to destroy America?” This “immigration problem”, for example, could be solved in 1 day if we wanted to do so.</p> <p>People are gaining an understanding that we are not fighting a battle to “get our Washington to understand the problem” rather it is Washington that is the problem&#8212;and sending a so-called represinative to that city does no good. It changes nothing. The politicians – or more exactly the people our politicians answer to – want to create these problems. Why?</p> <p>The illegal invasion, the destruction of our economy, the astronomical debt, the trade deficit, needless wars, the failed healthcare system, the thousands of tons of illegal drugs, and the list goes on and on. More and more people are waking up to the fact these crisis are all being promoted by our government in order to bring this nation into the North American Union.</p> <p>Problems like illegal immigration have been created intentionally in order to destroy America. We have been programmed to be stupid with our public education system, fluoride in water, mercury in our vaccines, poisons in the air and food and water. While I strongly advocate being aware of what is going on, I also believe that we are now too far down the toilet to be extracted. 						 <p>According to President Obama and Attorney General Eric Holder, the Justice Department is currently in the process of deciding whether or not to file suit over Arizona's controversial immigration law, which Mr. Obama has called &quot;misguided&quot; and potentially discriminatory.</p> <p>I woke up today and turn on CNN and report said, &quot;Hilary Clinton drops a bomb.&quot; According to that report it, and based on recent statements by Secretary of State Hillary Clinton, the decision to sue Arizona has already been made.</p> <p>The Arizona law, which would go into effect in July, requires immigrants in the state to carry documents verifying their immigration status and requires police officers to question a person about his or her immigration status during a &quot;lawful stop&quot; if there is &quot;reasonable suspicion&quot; that person may be in the country illegally.</p> <p>Holder has indicated that he believes &quot;the law is an unfortunate one that will be subject to potential abuse&quot; and said that the Justice Department is &quot;considering a court challenge.&quot;</p> <p>It is not clear whether Clinton was just making a prediction or whether she was getting ahead of a planned announcement by the administration. The Justice Department said today it is continuing to review the law.</p> <p>Arizona Gov. Jan Brewer expressed outrage Thursday over Secretary of State Hillary Clinton's comments that the Obama administration will sue over Arizona's controversial immigration law &#8212; and Brewer said she's ready for a fight.</p> <p>We are not going to back away from this issue,&quot; Brewer said. &quot;We are going to pursue it, we're going to be very aggressive,&quot; Brewer said. &quot;We'll meet them in court &#8230; And we will win.&quot;</p> <p>She added: &quot;The population of America agrees with Arizona.&quot;</p> <p>Despite the statements by Clinton, a Justice spokesman said they could not confirm whether the White House directed the department to sue. The some source said the White House would be within its rights to do so. &quot;It would not be inappropriate for the White House to tell us to sue. It's not a criminal matter,&quot; the official said.</p> <p>The law requires police investigating another incident or crime to ask people about their immigration status if there's a &quot;reasonable suspicion&quot; they're in the country illegally. It also makes being in Arizona illegally a misdemeanor, and it prohibits seeking day-labor work along the state's streets.</p> <p>The law's stated intention is to drive illegal immigrants out of Arizona and discourage them from coming in the first place. It has outraged civil rights groups, drawn criticism from Obama and led to marches and protests organized by people on both sides of the issue.</p> <p>Critics say it will lead to racial profiling and discrimination against Hispanics, and damage ties between police and minority communities. The law's backers say Congress isn't doing anything meaningful about illegal immigration, so it's the state's duty to address the issue.</p> <p>The Republican governor said she has sent five letters to the White House about the problem of illegal immigration in her state and all have gone unanswered.</p> <p>“I’ve spoken to the President personally in regard to that,” Brewer said last week about the unanswered letters, calling the non-response a “complete and total disrespect to the people of Arizona. 						 <p>01.08.10 - PHOENIX — Two officials said Thursday night they have been subpoenaed to answer questions next week before a federal grand jury about a high-profile Arizona sheriff who gained attention for aggressively cracking down on illegal immigration.</p> <p>In statements read by a county spokesman, Maricopa County Manager David Smith and Deputy County Manager Sandi Wilson said they met with a federal prosecutor to discuss the case and will testify Wednesday.</p> <p>Wilson said the general subject of the inquiry was abuses by Sheriff Joe Arpaio's office. Neither Wilson nor Smith offered specifics, said county spokesman Richard de Uriarte, who spoke with the two officials Thursday night.</p> <p>Arpaio is widely known for tough jail policies and pushing the bounds on local immigration efforts. He has led a dozen crime and immigration sweeps, some in heavily Latino areas.</p> <p>Critics allege that some of Arpaio's deputies racially profiled people during immigration sweeps. But Arpaio maintains that people pulled over in the sweeps were approached because deputies had probable cause to believe they had committed crimes.</p> <p>Sheriff's spokesman Brian Lee said Arpaio was declining to comment on reports of the investigation. &quot;He has stated that we will conduct business as usual,&quot; Lee said.</p> <p>Sandy Raynor, a spokeswoman for the U.S attorney's office in Phoenix, said she couldn't confirm or deny a grand jury investigation.</p> <p>Arpaio and an ally are embroiled in nasty legal disputes with county officials and judges. Two county supervisors and one county judge have been criminally charged in investigations by Arpaio and County Attorney Andrew Thomas.</p> <p>Last month, Arpaio and Thomas filed a federal racketeering lawsuit against a group of county administrators, judges and attorneys, accusing them of participating in a conspiracy to hinder an investigation into a $341 million court building under construction in Phoenix and the investigation of Supervisor Don Stapley.</p> <p>He was told in March that his office is being investigated by the U.S. Department of Justice over allegations of discrimination and unconstitutional searches and seizures.
