						 <p>Democrats in Delaware have resuscitated a legislation plan that would declare sheriffs in the state have <strong>no power to make arrests</strong> after a GOP proposal on the issue was withdrawn by the sponsor. Under both bills, the sheriff and his deputies would be stripped of all authority to enforce any laws including traffic stops.</p> <p>What is so important about this Bill and why it should have people in every state in the union shouting from the roof tops, is that if this Bill had passed you have got to believe that a similar Bill will be crafted in all the other states. <a href="http://www.saveamericafoundation.com/2012/05/08/urgent-news-attacks-on-county-sheriffs-is-beginning-in-delaware-by-fred-brownbill/" target="_blank">Fred Brownbill</a>, President of the Save America Foundation had this to say:</p> <p>Delaware State Bill 325 was introduced on May 3rd and is virtually identical to a bill put forward by Republican Rep. Danny Short. The initial legislation, HB 290, was proposed at the behest of Sussex County officials who took issue with their sheriff, Jeff Christopher, who is attempting to restore the office to its constitutional role.</p> <p>Rep. Short announced he was striking the bill from further consideration, saying it was being hijacked for political purposes. However it will appear the damage has been done and this bill has indeed been hijacked. Both bills stated “‘Police officer’ as used in this code shall not include sheriffs and sheriff deputies,” and that it “is the intent of the General Assembly to specifically state the sheriffs and their deputies do not have any arrest authority.”</p> <blockquote> <p>As Sheriff, Jeff Christopher has been stopping cars and acting as a law enforcement officer. But that is in direct conflict with state law and the AG’s opinion, which say the sheriff’s “power to arrest is no greater than that shared by any citizen.” Sheriff Christopher has said he will continue to defy that opinion, prompting clarifying legislation. ~<em>House Bill 290 Talking Points</em></p> </blockquote> <p>Delaware State Bill 325, should it pass, will redefined the role of sheriffs to where they can serve papers and process administrative work but have no hand in actual law enforcement. 						 <p>UPDATE: Governor Jan Brewer has vetoed a bill (HB2434) that would have affirmed the sheriffs of Arizona as the supreme constitutional law enforcement officers in their counties and was intended to place the federal government on notice that it must work through them to exercise their limited powers.</p> <blockquote> <p>Saying the proposal made no sense, Gov. Jan Brewer vetoed legislation Wednesday designed to let local law enforcement keep tabs on their federal counterparts.</p> <p>“Rather than hinder the efforts of our federal law enforcement colleagues, we need to focus on collaboration,” she wrote. “Establishing arbitrary reporting requirements for our federal partners takes us in the wrong direction.”</p> </blockquote> <p>Obviously, Brewer doesn’t understand – or maybe doesn’t mind – that most of what the feds do is unconstitutional, and that this measure is a small but important step to reasserting the proper chain of authority. First, it serves notice to the federal government that its authorities operate in Arizona with oversight and reaffirms the sovereignty of the state. Secondly, it puts the county sheriff in the position to protect the rights and liberties of Arizona citizens from federal overreach.</p> <p>HB2434 affirms the sheriffs of Arizona as the supreme constitutional law enforcement officers in their counties and serves notice to the federal government that it must work through them to exercise their limited powers.</p> <p>The bill simply states that:</p> <blockquote> <p>A. Before taking any official law enforcement action in a county in this state, a federal law enforcement officer shall notify the sheriff of the county, unless the notification would impede the federal officer’s duties.</p> <p>B. If a federal law enforcement officer does not notify the sheriff pursuant to subsection A. of this section, the federal law enforcement officer shall notify the sheriff of the county as soon as practicable after taking the action.</p> </blockquote> <p>After the original version of HB2434 dealing with bail bond prohibitions passed the House unanimously last month, the Senate used a maneuver called “strike everything,” which allows lawmakers to substitute a new bill into an existing bill number. The Senate passed the federal law enforcement notification legislation 20-8 on April 4. The House took up the new bill and passed it 38-17 on April 9. The legislation now moves on the Gov. Brewer for her signature.</p> <p>“I think it’s important that it’s establishing the sheriff as the lead over the feds,” Tenth Amendment Center director Michael Boldin said.</p> <p>The Constitution limits the authority of the federal government to specific enumerated powers, leaving all others to the states and their people. As a result, federal law enforcement officers may only exercise authority flowing from those powers. Any action taken by a federal law enforcement officer outside of those powers breaks the law. For example, the Constitution delegates no drug enforcement power to the federal government. Therefore, the DEA has no legitimate authority to conduct a raid on a medical marijuana clinic operating legally within a state.</p> <p>The Arizona bill creates a check on federal power through the county sheriffs. With the feds required to notify the local authorities, the sheriff can conceivably exercise the option to stop unwarranted action before it happens, creating a layer of protection for the Arizona citizen.</p> <p>“The idea that power should be checked and balanced serves as a cornerstone in the American political system,” TAC communications director Mike Maharrey said. “Federal law enforcement officers have acted with immunity, exercising unwarranted powers, for far too long. Just read the news stories about armed agents raiding Amish dairy operations because some poor old farmer commits the horrible crime of selling raw milk. This bill reestablishes the primacy of sheriff in Arizona and puts in place a mechanism to protect the average Arizonian. 						 <p>Sheriff Jeff Christopher of Sussex County, Delaware, when he was elected to the office in 2010, thought he was handpicked by the people to represent them as the highest-ranking law officer in the county. Instead, he has found himself in the middle of a fight for the future of American law enforcement as a result of a nationwide effort to abolish the sheriff’s office altogether.</p> <p>It is one more example of federal and state governments ignoring the will of the people as well state laws. In the case of Delaware, the state’s own constitution stipulates that the office of the sheriff is a constitutionally created position just like the secretary of state and the attorney general. Delaware’s Constitution states: “The sheriffs shall be conservators of the peace within the counties &#8230; in which they reside.”</p> <p>This time it is Delaware Attorney General Beau Biden, son of Vice President Joe Biden, sending out mandates to commissioners informing them that their sheriffs no longer have arrest powers. In an opinion released Feb. 24, State Solicitor L.W. Lewis said that neither the state nor the common law grants arrest powers to the county sheriffs.</p> <p>It would appear that Lewis is a little confused. The office of sheriff was created more than a century before the official founding of the United States. 						 <p>PHOENIX – Arizona continues to set the stage as a battleground pitting local and state’s rights against the federal government’s inclination to control how states are allowed to govern their own affairs.</p> <p>The Department of Justice in Washington has accused Sheriff Joe Arapio’s Office of engaging in what they describe as ‘racial profiling and mistreatment of illegals aliens and hispanics’ and alleged ‘human rights violations’ in its patrols and jails.</p> <p>The DOJ has refused to present any of its alleged evidence to support their charges, yet, they are still moving forward and are threatening to sue if Arpaio does not comply. Not intimidated by Washington’s threats, Maricopa County’s own Attorney General <a href="http://www.azcentral.com/news/politics/articles/2012/04/04/20120404joe-arpaio-federal-investigation-county-response.html" target="_blank">Bill Mongomery told the DOJ yesterday</a>, “put up or shut up”.</p> <p>Negotiations between the Sheriff’s Office and the DOJ came to a halt on Tuesday when Arpaio flatly refused to allow a court-appointed embedded DOJ ”monitor” stationed in his office full-time, a move which many critics describe as a federal power-grab, aimed at controlling Arpaio, a duly elected office holder representing 4.5 million residents in the Phoenix area.</p> <p>Maricopa County is not the only Sheriff’s office under DOJ investigation. Arpaio explains, “They been investigating 20 other departments recently with their civil rrights unit in the Department of Justice.” In an earlier <a href="http://www.youtube.com/watch?v=B5KnQVvVFPs" target="_blank">FOX interview last December</a>, Arpaio stated flatly, “I’m not going to back down because of politics, because the President wants to get the hispanic vote.”</p> <p>“What is this, a poker game? They want to go to court, we’ll be glad to meet them in court”, blasted Arpaio.</p> <p><iframe width="560" height="315" src="http://www.youtube.com/embed/feVLB9aYQx0" frameborder="0" allowfullscreen=""></iframe></p> <p>The DOJ has already spent millions of dollars to date through their three year investigation into Arpaio’s office, including applying pressure on Arpaio to resign as elected Sheriff.</p> <p>If a compromise cannot be reached between the two parties, the DOJ contends that it will file a federal lawsuit against Maricopa County Sheriff’s Office, a legal battle which is likely to cost millions for both sides, and could drag on for years.</p> <p>There may be other political reasons to force an Arpaio resignation in 2012, besides what critics claim as currying favor with Arizona’s hispanic voting bloc before the November elections. Corsi said he assisted in the sheriff’s investigation, which has been going on for six months and was run through Arpaio’s “Cold Case Posse.” The sheriff said the investigation was funded completely by donations from private citizens.</p> <p>Questions over Mr. Obama’s birth certificate have been a political sideshow for the last four years, and have persisted despite repeated denials by the White House, and despite the release of evidence he was born in Honolulu, Hawaii, on Aug. 4, 1961. Babeu denies any wrongdoing.</p> <p>Pinal County Sheriff Paul Babeu built a reputation as a rising, conservative star by taking a hardline stance against illegal immigration, attacking the Obama administration and appearing alongside Sen. John McCain in a 2010 re-election ad in which McCain urged federal officials to just &quot;complete the danged fence.&quot;</p> <p>But, on Saturday, Babeu's conservative image took a beating as he was forced to confirm publicly that he is gay and was involved in a relationship with a Mexican immigrant who claims the sheriff threatened to have him deported if he revealed their relationship.</p> <p>Nearly 800 people commented on Babeu’s Facebook page under a statement posted by the sheriff denying the “false allegations” but acknowledged that he is homosexual.</p> <p>Saturday's revelation has already led Babeu to call presidential candidate Mitt Romney's staff to say he would step down from his post as state campaign co-chair. &quot;There is no question that his budding congressional campaign is over,&quot; longtime Arizona Republican political consultant Sean Noble wrote on his blog. &quot;Because it is a Republican primary in a conservative district, it's likely that the thing that hurts him the most is that he was in a gay relationship.&quot;</p> <p>“The issue is not sexual orientation,” Patricia Selliger commented. “The issue is hypocrisy — a public stand on border security all the while allowing an illegal alien to work on your website and conducting a personal relationship with him. 						 <p>Adding a new wrinkle to the phrase, &quot;I'm mad as hell, and I'm not taking it anymore,&quot; several California sheriffs, as well as one from Oregon, say they aren't cow-towing to the federal leviathan anymore.</p> <p>Last month, at the Yreka fairgrounds in northern California, the sheriffs - who, of course, are elected by the people - gathered with a large group to discuss what to do about Big Brother and his consistent meddling in state and local affairs.</p> <p>Speaking of the federal bureaucracy, Plumas County (California) Sheriff Greg Hagwood declared, &quot;A giant has been awakened, and they didn't count on that.&quot;</p> <p>One by one the sheriffs recounted their experiences with an ever-encroaching federal government, whether from the aspect of emergency management, the foisting upon local jurisdictions of federal mandates, or the passage of federal statutes which many now feel run roughshod over state and local governments, inhibiting their ability to mold their own laws and policies around the needs of their respective populations.</p> <p>&quot;I had spent a good part of my life enforcing the penal code, but not understanding my oath of office,&quot; Sheriff Dean Wilson of Del Norte (Sacramento) County told the group.</p> <p>&quot;I was ignorant and naive, but now I know of the assault against our people by the federal government,&quot; he said, receiving some of the loudest and longest applause of the gathering.</p> <p>Event host Sheriff John Lopey of Siskiyou (California) County said one of his biggest pet peeves was the federal government's ever-increasing environmental regulations.</p> <p>&quot;I have told federal and state officials over and over that, yes, we want to preserve the environment, but you care more about the fish, frogs, trees and birds than you do about the human race. 						 <p>A sheriff’s office outside of Houston is taking a big and potentially controversial step forward with a new piece of law enforcement technology. The Montgomery County Sheriff’s Office is prepping its deputies to fly a $300,000 unmanned <strong>ShadowHawk</strong> helicopter (paid for with a Homeland Security grant) that someday might carry a weapons payload.</p> <p>This wouldn’t mark the first time a law enforcement agency has put a drone in the air, but the potential for carrying anything besides a surveillance payload is unprecedented as far as we’ve heard. There won’t be any Hellfire missiles here, but ShadowHawk - built locally by a company called Vanguard Defense Industries&#8212;is designed to carry a range of less-lethal payloads, including Taser-esque weapons that deliver an electric charge or a firearm that fires beanbag rounds known as stun batons.</p> <p>Naturally, the very idea of this is fraught with controversies. Some local politicians and citizens are worried about invasions of privacy, while others are concerned that the drone will be put to use catching speed limit violators, an idea that caused some controversy in the Houston area back in 2007 (the idea was later scrapped).</p> <p>Sheriff Tommy Gage told local media in Houston that his department’s ShadowHawk would only be deployed in emergency circumstances (like a hunt for a missing person) or in situations where sheriff’s deputies know they are dealing with law breakers, such as when police are actively pursuing suspects on the ground or in hostage situations. It could also be deployed to aid area firefighters in wildfire situations (nearby Bastrop was ablaze for several days this summer, and wildfires have become an increasing problem in Texas in recent years).</p> <p>But weaponized law enforcement drones? Even loaded with a non-lethal payload the Montgomery Country Sheriff’s Department is dipping its toes in uncharted waters. Texas perhaps has a reputation for dealing unsympathetically with lawbreakers, but Texans are also fiercely protective of their civil liberties. Back on October 7th ten Arizona sheriffs, five Democrats and five Republicans representing most of Arizona's 15 counties, met in Phoenix to call the ATF/DOJ gun-walking operation, “a betrayal of state law enforcement.”</p> <p>The Sheriffs called Attorney General Eric Holder to account. For his part, Holder has promised a full investigation of the deadly gun smuggling by his Justice Department Inspector General. However, the sheriffs are demanding President Obama appoint a special counsel to investigate Eric Holder and his possible authorization of Project Gunrunner and its Arizona offspring, Operation Fast and Furious.</p> <p><iframe width="560" height="315" src="http://www.youtube.com/embed/IC2C2lIwNSA" frameborder="0" allowfullscreen=""></iframe></p> <p>Pinal County Sheriff, Babeu said, “We want to get to the bottom of this. This is a public safety issue, this is a threat against our deputies and local officers, not only in Arizona but across the Southwest.”</p> <p>Referring to the murder of Tucson District Border Patrol Agent, Brian Terry with a Fast and Furious smuggled weapon, Sheriff Babeu has also said, “If somebody gives a gun to somebody knowing they’re going to commit murder, guess what we call them? … We call them accomplices.”</p> <p>Attorney General, Eric Holder, answers questions about Gunrunner and Fast and Furious by telling Congress about ongoing internal Justice Department investigations. Holder does not mention the person investigating DOJ is its Acting Inspector General, Cynthia A. Schnedar, who has long, close ties to Eric Holder. In 1994, Schnedar served as assistant U.S. attorney in D.C. when Holder was U.S. attorney.</p> <p>A responsible inspector general would have immediately noted the obvious conflict of interest and stepped aside after calling for a special counsel to conduct an impartial inquiry. 						 <p>A law proposed in Tennessee would make federal law enforcement have to seek the approval of the local Sheriff's office in order to make arrests or conduct raids in the state. This is part of a larger movement by the states to force the federal government to respect the 10th amendment.</p> <blockquote> <p>A new bill making its way through the Tennessee General Assembly states that a federal employee who is not designated as a Tennessee peace officer may not make an arrest or conduct a search and seizure in the Volunteer State without the express consent of the sheriff of the county in which the arrest, search, and seizure is to occur except under certain enumerated circumstances.</p> <p>No vague request will satisfy the mandates of the measure were it to be enacted by the General Assembly of the Tennessee and signed into law by the governor. In fact, the bill explicitly requires that the permission request contain the following information:</p> <p>(A) The name of the subject of the arrest, search, or seizure;<br /> (B) A clear statement of probable cause for the arrest, search, or seizure or a federal arrest, search, or seizure warrant that contains a clear statement of probable cause;<br /> seized;<br /> (C) A description of the specific things to be searched for or<br /> (D) A statement of the date and time that the arrest, search, or seizure is to occur; and<br /> (E) The address or location where the intended arrest, search, or seizure will be attempted.</p> <p>The serious and very powerful posture struck by the measure is undeniable. In Section 1, Paragraph (f), the proposed law sets forth the punishments to be imposed upon a federal officer failing to conform to the dictates thereof:</p> <p>An arrest, search, or seizure or attempted arrest, search, or seizure in violation of subsection (a) is unlawful, and the persons involved shall be prosecuted by the county attorney for kidnapping if an arrest or attempted arrest occurred, for trespass if a search or attempted search occurred, for theft if a seizure or attempted seizure occurred, and for any applicable homicide offense if loss of life occurred. The persons involved shall also be charged with any other applicable criminal offense.</p> <p>Furthermore, if any county attorney fails to timely and properly prosecute the federal agent accused of violating the law’s mandates regarding arrest, search, and seizure, that attorney is subject to recall by the voters and “to prosecution by the attorney general for official misconduct.</p> </blockquote> <p>Under the wording of our Constitution the County Sheriff has always been the final authority in authorizing arrests and searches and seizures. As the politicians in the federal government have incrementally usurped the rights given to the sovereign states and set aside the dictates of Posse Comitatus, the agents of the federal government have taken control of the responsibilities that rightfully belong to the Sheriff of each county.</p> <p>This usurpation is most visible in the airports throughout our country. Nowhere in the constitution is exception given to exempt airports from the safeguards against illegal search and seizure and sexual assault practiced daily by federal agents of the TSA. In the recent past our airport security was conducted by private security organizations under the watchful eyes of sheriff deputies in keeping with the lawful requirements of our constitution. The efficiency of that system was much better than the documented lack of efficiency associated with the TSA.</p> <p>The widespread takeover of law enforcement duties by federal agents has transformed our country into a police state that promises to continue to grow. It's time we return to the county sheriffs as the primary law enforcement officials.
